1. These Terms of Service govern your access to and use of Cuina’s platform, which provides an online marketplace where sellers of cottage food, farm stand goods, and other handcrafted items can list their products and where buyers can browse, place orders, and arrange delivery or pickup. By using Cuina, you agree to these Terms.
  2. Cuina is not a seller of any products offered on the platform. We do not prepare, package, handle, or deliver food or other goods. We only provide the digital infrastructure that connects buyers and sellers and facilitates transactions. All sales are made directly between the buyer and the seller, and Cuina is not a party to those contracts.
  3. Sellers are solely responsible for complying with all applicable local, state, and federal laws and regulations, including those relating to food safety, labeling, permits, and business operations. Sellers must ensure that products are safe, legal, and properly represented. Sellers agree that they, and not Cuina, are liable for any claims or disputes related to their products.
  4. Buyers are solely responsible for understanding what they are purchasing. This includes reviewing ingredients, allergens, expiration dates, and any risks related to consuming or using the products. By purchasing from Cuina sellers, buyers acknowledge that consumption or use of products is at their own risk.
  5. Cuina does not guarantee the quality, safety, legality, or fitness for purpose of any goods sold on the platform. Cuina is not liable for any illness, injury, damage, or other loss that may arise from transactions between buyers and sellers.
  6. Payment processing services for Cuina are provided by Stripe, a third-party payment provider. By placing an order on Cuina, you also agree to be bound by Stripe’s terms and conditions. Cuina does not store payment card details and is not responsible for errors, delays, chargebacks, or disputes managed through Stripe. Sellers are responsible for ensuring that their Stripe accounts are set up correctly and remain in good standing. Buyers are responsible for providing accurate payment information.
  7. Cuina may facilitate communication, delivery scheduling, or other logistics between buyers and sellers, but responsibility for fulfillment remains with the seller. If issues arise in delivery, product quality, or legal compliance, those must be resolved directly between the buyer and the seller. Cuina may, at its discretion, assist with dispute resolution but is not obligated to do so and does not assume liability for the outcome.
  8. By using the platform, you agree to indemnify and hold Cuina harmless from any claims, damages, losses, liabilities, costs, or expenses (including legal fees) arising out of or relating to your use of the platform, your purchase or sale of goods, or your violation of applicable laws or these Terms.
  9. Cuina reserves the right to suspend or terminate accounts that violate these Terms or that otherwise pose a risk to buyers, sellers, or the integrity of the platform. Continued use of the platform constitutes acceptance of the most current version of these Terms.
